Terms of Service

Welcome to RealCasual Games! These Terms of Service (“Terms”) govern your use of the mobile games and related services offered by RealCasual Games (“Company,” “we,” “us,” or “our”), including, but not limited to, the “Blackjack” game and other casual titles (collectively, the “Service”).

1. Acceptance of Terms

By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not install, access, or use the Service.

NOTICE: These Terms contain a binding arbitration clause and a class action waiver. Please read Section 13 carefully.

2. Eligibility and Age Restrictions

  • Minimum Age: You must be at least 13 years of age to use the Service. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), your parent or legal guardian must review and agree to these Terms on your behalf.
  • No Real Money Wagers: The Service, including our game “Blackjack,” is for entertainment purposes only and operates as a social casino or casual game. No real money wagering or real money prizes are offered or permitted in the Service.
  • Jurisdiction: You are solely responsible for ensuring that you comply with all local laws and regulations regarding the use of mobile applications and games in your jurisdiction.

3. Limited License to Use the Service

Subject to your compliance with these Terms, RealCasual Games grants you a revocable, non-exclusive, non-transferable, non-sublicensable, limited right and license to install and use the Service solely for your personal, non-commercial entertainment purposes.

  • Virtual Items: The Service may include Virtual Items (e.g., virtual chips, coins, or in-game currency). You acknowledge that Virtual Items have no cash value and are non-transferable. You do not own the Virtual Items; you purchase a limited, revocable license to use them within the Service. Any balance of Virtual Items does not constitute a real-world balance or reflected value.

4. Account Information

  • Google Play Games Services: You may be required to register for an account through a third-party service (e.g., Google Play Games Services). You are responsible for all activities that occur under your account.
  • Account Security: You agree to maintain the confidentiality of your login credentials and are solely responsible for all actions taken through your account.
  • Suspension and Termination: We reserve the right to suspend or terminate your account and access to the Service at any time, for any reason or no reason, including without limitation, if you violate any of these Terms.

5. In-App Purchases and Payment Terms

  • Purchases: The Service may offer in-app purchases of Virtual Items. When you make a purchase, you agree to the pricing, payment, and billing terms presented to you at the time of purchase.
  • Payment Processor: All payment transactions are handled by the platform provider (e.g., Google Play Store) or a designated third-party payment processor. RealCasual Games does not collect or store your payment details.
  • No Refunds: ALL PURCHASES OF VIRTUAL ITEMS ARE FINAL AND NON-REFUNDABLE, unless otherwise required by applicable law or the policy of the relevant app store platform.

6. Acceptable Use Policy and Prohibited Conduct

You agree that you will not:

  1. Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  2. Use the Service for commercial purposes, including offering any unauthorized sales or advertisements.
  3. Attempt to hack, reverse engineer, decompile, or disassemble any part of the Service.
  4. Interfere with or disrupt the operation of the Service or the servers or networks connected to the Service.
  5. Cheat, use exploits, automation software, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Service.
  6. Create a false identity, impersonate any person or entity, or falsely state or otherwise misrepresent your age or affiliation.
  7. Transfer your account or Virtual Items to another person or entity.

7. Intellectual Property Ownership

  • RealCasual Games Property: The Service, including all code, graphics, user interfaces, game content, and trademarks, is owned by RealCasual Games and is protected by intellectual property laws.
  • License Grant: By accepting these Terms, you only receive a limited license to use the Service as expressly stated in Section 3. You do not acquire any ownership rights in the Service or any of its content.

8. User Content (If applicable)

If the Service allows you to create, upload, or post any content (such as chat messages, avatars, or game descriptions) (“User Content”), you grant RealCasual Games a worldwide, irrevocable, perpetual, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display your User Content in connection with the Service.

9. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Please review the Privacy Policy to understand our practices regarding the collection, use, and disclosure of your information.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. REALCASUAL GAMES EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. REALCASUAL GAMES MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT SHALL REALCASUAL GAMES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

12. Changes to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Governing Law, Arbitration, and Class Action Waiver

  • Governing Law: These Terms shall be governed by the laws of the State of California, U.S.A., without regard to its conflict of law principles.
  • Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules.
  • Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class-action-basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
